Florida timeshare resale promises need a paper pause
A Florida timeshare resale pitch can sound urgent, so slow down before paying upfront fees or trusting a ready-buyer promise.
A timeshare resale call can sound like good news when an owner wants out. Do not pay or give card details until the offer is in writing. The contract should name the company, fees, buyer claim, and right to cancel.
Florida law sets a test for a “buyer waiting” pitch. A resale ad company cannot claim an interested buyer without giving that person’s name, address, and phone number. It also needs records before it claims past sales or rentals.
A consumer may cancel a resale ad contract within 10 days after signing. The company must honor a notice sent on time. It generally must return the money within 20 days after getting the notice. If a check has not cleared, the deadline is 5 days after it clears, whichever date is later. Follow the delivery method in the contract and keep proof of sending.
Gather the resort name, deed or member papers, loan balance, yearly fees, and any listing deal. Check the caller and company on your own. Then call the resort at a number you found yourself. A real resale path can survive that pause.
The 10-day rule does not make every offer safe or erase another deal. Use the current law and state complaint route, not the callback number in the message.
